In detail

How family violence safety notice works in practice.

A family violence safety notice is issued by police under the Family Violence Protection Act 2008 (Vic) when attending a family violence incident. Police can issue the notice without a court order if they believe it is necessary to protect the affected family member. The notice takes effect immediately and imposes conditions on the respondent, which may include prohibitions on contact and a requirement to leave the shared residence. The notice automatically becomes an interim intervention order at the first court date. Contravening a safety notice is a criminal offence.
