The fee depends on the charge category, expected number of court appearances, and whether the matter is heading for a plea or contested hearing. Initial consultations are no-obligation, and the fixed quote is confirmed in writing before any work begins. Where Legal Aid funding may apply we will say so up front. We do not charge by the hour for routine matters in the Victorian Magistrates' Court.

For most criminal charges in Victoria you will need to appear at the Victorian Magistrates' Court at least once. In some matters, an application for diversion or a plea by post can avoid full attendance.

For most charges in the Victorian Magistrates' Court, the accused is expected to attend in person. The exceptions are limited: diversion applications under section 59 of the Criminal Procedure Act 2009 may be resolved without conviction; some traffic-related summary matters can be dealt with on the papers; and where the accused is medically unable to attend, an application can be made for the matter to proceed in absence. We will tell you at the first call whether your matter is one that requires attendance.

Sentencing courts give weight to the timing of the plea: a plea entered at first mention typically attracts a higher sentencing discount than one entered on the morning of trial. Equally, a not-guilty plea cannot ordinarily be reversed once a hearing has been completed and a finding has been entered. Strategy on plea timing is something we work through together once the brief has been reviewed.

Yes for eligible matters. Legal Aid Victoria funds defence work for serious criminal charges where the means and matter tests are met. We will assess eligibility at the first call.

Tringali Lawyers accepts grants of legal assistance from Legal Aid Victoria where the matter and means tests are satisfied. Legal Aid funding is available for indictable matters and certain serious summary offences, subject to the applicant's financial position. At the first call we will give a frank view of whether Legal Aid is likely to apply. Where Legal Aid funding is not granted, fixed-fee private representation remains available, with the quote confirmed up front.
