How breach of intervention order works in practice.
Contravening a condition of an intervention order is a criminal offence in Victoria. A breach of a family violence intervention order is prosecuted under the Family Violence Protection Act 2008 and can result in a term of imprisonment. A breach can include making contact in any form, approaching the protected person, or attending a location prohibited by the order. Police take breach allegations seriously and will generally charge if there is evidence of contact. The existence of the prior order, and its conditions, forms part of the prosecution brief for any breach charge.
