How record of interview works in practice.

A record of interview is the formal documentation of a police interview with a person suspected of an offence. In Victoria, interviews are usually recorded electronically and a transcript is produced. The record of interview becomes evidence and forms part of the brief of evidence served on the accused. What a person says, or does not say, in a record of interview can be used at trial or hearing. Police are required to administer a caution before questioning. A suspect is entitled to speak to a lawyer before agreeing to be interviewed.
